Terms of Service

These Terms of Service (“Terms”) apply to the use of the Miami Bag online store and website (the “Store”) and any orders placed through it.

1. General Provisions

1.1. The Store is operated by Miami Bag (the “Supplier”, “we”, “us”, “our”).

1.2. By accessing or using the Store, browsing content, clicking on links or buttons, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Return & Refund Policy.

1.3. These Terms constitute a legally binding agreement between the Supplier and any natural person or legal entity that places an order through the Store (the “Customer”, “User”, “you”).

1.4. All content on the Store, including texts, photos, images, product descriptions, logos, and branding elements, is protected by intellectual property rights and may not be used, copied, reproduced, published, or distributed without our prior written consent, except as expressly permitted by law.

1.5. Prices displayed on the Store are final retail prices in [EUR / market currency], and include applicable taxes where required. Shipping costs are shown separately at checkout unless stated otherwise.

1.6. We may change product prices, promotions, and availability at any time without the need to update these Terms. The price applicable to your purchase is the price shown at checkout at the time of ordering.

1.7. We take reasonable care to keep information on the Store up to date; however, we do not guarantee that all information is complete, accurate, or error-free at all times.

1.8. We do not guarantee uninterrupted access to the Store. Maintenance, updates, technical issues, or factors outside our control may temporarily affect availability.

1.9. To the extent permitted by law, you agree to indemnify and hold us harmless from losses, costs, damages, and reasonable legal fees arising from your breach of these Terms or unlawful use of the Store.


2. Formation of the Purchase Contract

2.1. Product listings and descriptions on the Store are an online catalog and do not constitute a legally binding offer. By placing an order, you submit a binding offer to purchase the products in your cart.

2.2. To place an order, you may be asked to provide personal data such as your name, address, phone number, and email. We process this information only as necessary to process and fulfill your order and provide customer support, in accordance with our Privacy Policy.

2.3. After you place an order, you will receive an order confirmation. This confirmation does not constitute acceptance of your offer. The contract is formed when we:

  • send you a shipment confirmation email; and/or
  • dispatch the goods to you.

2.4. By clicking “Place order” (or similar) and confirming acceptance of these Terms and the Privacy Policy, you confirm your intent to be bound by this purchase contract. In case of disputes regarding who placed an order, the person whose details were submitted during checkout will be treated as the contracting party.


3. Shipping and Delivery

3.1. We deliver to [/ European Union / United Kingdom / other countries]. Available delivery options and estimated delivery times are displayed at checkout and may vary by destination.

3.2. Estimated delivery times are not guaranteed. Delays may occur due to courier operations, customs checks, public holidays, force majeure events, or circumstances outside our control.

3.3. Product availability is shown on the Store; however, in rare cases, an item may become unavailable after an order is placed. If we cannot fulfill your order due to lack of stock, we will notify you as soon as reasonably possible and offer a refund or an alternative solution.

3.4. Before you place an order, we display the total order amount, including taxes (where applicable) and shipping fees.

3.5. Free shipping thresholds (if applicable) are shown on the Store and at checkout.


4. Payments

4.1. Payments can be made through the payment methods offered at checkout, which may include:

  • Credit/debit card payments

4.2. If you choose to pay by card, your payment is processed through our payment service providers. We do not store or process your full payment card details. Payment security is handled through encrypted connections (SSL) and the payment provider’s security measures.


5. Right of Withdrawal (Returns) and Refunds

5.1. If you are a consumer (as defined by applicable law), you have the right to withdraw from the purchase contract within 14 days from the date you receive the goods, without stating a reason, subject to the conditions in our Return & Refund Policy.

5.2. To exercise your right of withdrawal, you must notify us within the withdrawal period by emailing support@miami-bag.com and follow the return instructions provided.

5.3. Return shipping costs are generally the responsibility of the customer, except where the return is due to a defect or our error, as described in our Return & Refund Policy.

5.4. After we receive and inspect the returned item and confirm it meets the return conditions, we will process the refund within the timeframes stated in our Return & Refund Policy.


6. Warranty and Claims

6.1. You may submit a claim if:

  • the delivered item does not match the product you ordered (wrong color, size, model), and this can be established through ordinary inspection;
  • the item has a manufacturing defect; or
  • the item was damaged during transportation.

6.2. In such cases, please contact support@miami-bag.com within 48 hours of delivery and provide your order number and clear photos.

6.3. Where the claim is valid, we will offer an appropriate remedy, which may include replacement, repair (if applicable), or a refund, depending on the circumstances and legal requirements.


7. Intellectual Property

All intellectual property rights in the Store and its content belong to Miami Bag or our licensors. Unauthorized use, reproduction, distribution, or commercial exploitation is prohibited.


8. Limitation of Liability

To the extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages arising from the use of the Store or inability to access it.
  • We are not responsible for delays or failures caused by events outside our reasonable control (force majeure), including courier delays, customs delays, or technical outages.

Nothing in these Terms limits liability where it cannot be excluded under applicable law.


9. Governing Law and Disputes

Unless otherwise required by applicable consumer law, these Terms and any disputes arising out of or relating to them are governed by the laws of the European Union.

If you are a consumer in the EU/EEA/UK, you may also benefit from mandatory consumer protection laws of your country of residence.


10. Changes to These Terms

We may update these Terms from time to time for legal, operational, or business reasons. Updated Terms will be posted on the Store with a revised “Effective date”.
